I had a shipment of 250 bottles of e-liquid, the Nicotine flavored liquid that is used for refilling Electronic Cigarettes, Refused Admission into the USA by the FDA!
The shipment was sent to me from a company in the Netherlands, who is based in China.
UPS handed the shipment over to US Customs, who then passed it on to the FDA for investigation.
The package was shipped on April 10th, 2009.

The final Refusal of Admission was given to me on May 5th, 2009, stating the following reason:
Refused: 2,500 ml
FPLA Section Section 4(a); 801(a)(3) Misbranding
The article appears in violation of FPLA because of its placement, form and/or contents statement.

Hope this helps to clarify actual refusals. This was my first, and last, shipment held by FDA.
The FDA  is stepping up its efforts I would say. It may not effect everyone yet,
But sometimes I think it would be better to fight a complete Ban, than to be picked off one by one!

I think we should all BOYCOT UPS..  USE the china postal.. Just for overseas ..  EMA has never been stop.. They get to the usa and the us postal unite takes it .. They deliver.. I have never had a shippment stopped useing them..  I tell them to put computer boards on the customes note.. 

Yes. EMS is much better. However, after doing a search on the FDA website, there has been
about 3 shipments seized during this month from EMS.
It is just a matter of time. Also, be careful, as my shipments always said personal vaporizer,
which is basically the truth. If they put memory boards, like David Yang does, and it even gets looked at
in customs for any reason, you will have a big mess. If it is a complete lie about what is in the box,
then the FDA will want to know why the exporter lied on the customs forms, which is a serious offense,
and even without that, you will now have to explain to them what it really is and why it does not even
come within the same universe of items! This happened to Jason from Wicked e-liquid back in January
of this year. The company in China lied on the customs forms, and it took them a month to sort it all out!

Oh, and a quick update! PayPal refunded my purchase for non-delivery. But they also refused the shipment
of e-liquids due to "Mis-Branding, due to contents form etc"
So be aware guys, if FDA sees it, you ain't gonna get it!
So thank goodness I used PayPal or I would have been out all $.

I saw on another forum that they are putting false product names on the ems slips.. And it is working...  if there is a will there is a way...
